Terms of Service (EU Online Store)

These Terms of Service (the “Terms”) govern your access to and use of the EU facing online store and related services available at anexbaby.com (the “Site”). By placing an order or otherwise using the Site, you agree to be bound by these Terms.

B2C focus: These Terms apply to consumers within the meaning of applicable EU/EEA/UK consumer law. If you purchase as a business customer, separate terms may apply.

2. Scope and languages

These Terms apply to purchases and the use of the Site by customers located in the European Union, EEA and Switzerland. The contract language is English unless a local language version is expressly offered. Nothing in these Terms deprives you of the mandatory consumer protection of your country of habitual residence. Products may not be sold or exported to countries subject to EU sanctions or other trade restrictions.

3. Eligibility

You must be at least 18 years old and have legal capacity to conclude a contract. If you order on behalf of another person, you represent that you are authorized to do so.

4. Our products, information and availability

Product images are for illustration; minor variations may occur. Dimensions and weights are approximate. We may change products, bundles, prices and promotions at any time before your order is accepted. All offers are subject to availability.

5. Prices, taxes and shipping costs

Displayed prices are shown in your selected currency and include VAT where applicable. All payments are processed in EUR/PLN (unless otherwise agreed). Shipping costs, if any, are shown separately at checkout. Any import duties or customs charges (if applicable to your destination) are your responsibility and will be disclosed where reasonably foreseeable. We issue invoices electronically.

6. Ordering process and contract conclusion

  • Add to cart the desired items and proceed to checkout.
  • Provide billing/shipping details and choose a payment method.
  • Review your order summary (items, total price incl. taxes/fees, shipping costs, delivery options).
  • Submit your order by clicking the button clearly labelled with an obligation to pay (e.g., “Buy now”).

After placing an order, you will receive an acknowledgement email. This is not our acceptance. A binding purchase contract is concluded when we dispatch the goods and send you a shipping/acceptance confirmation. If we are unable to accept your order, we will notify you and refund any payment taken.

7. Payment

We accept the payment methods presented at checkout (e.g., major cards, PayPal, instant transfer). Payments are processed by certified payment providers; we do not store full card data. We may perform standard anti-fraud checks. Your order may be declined if a payment cannot be authorised. All payment transactions are encrypted and processed in compliance with PCI DSS security standards.

8. Delivery

8.1 Destinations

We deliver to the countries listed on the Site at checkout. Delivery restrictions may apply to certain remote areas.

8.2 Dispatch times and delivery dates

Estimated dispatch and delivery timeframes are shown at checkout and in your order confirmation. These are estimates only; delays may occur due to carrier issues, customs or events beyond our control. If we miss a confirmed delivery deadline and the delivery is essential (taking into account all circumstances), you may be entitled to remedies under consumer law.

8.3 Partial shipments

We may ship items separately at no additional cost. You will only pay one set of shipping fees per order, if applicable.

8.4 Transfer of risk and title

Risk of accidental loss or deterioration of the goods passes to you upon delivery to your address or a nominated pickup point. Title to goods passes when we receive full payment.

9. Right of withdrawal (EU/EEA consumers)

You have the right to withdraw from the purchase within 14 days without giving any reason, starting from the day you or a third party indicated by you (other than the carrier) acquires physical possession of the goods. To exercise the right, inform us of your decision within the period using an unambiguous statement (e.g., email). You may use the Model Withdrawal Form in Annex A, but it is not mandatory.

Effects of withdrawal: We will refund all payments received from you, including standard delivery costs (but excluding supplementary costs resulting from a non standard delivery you chose), without undue delay and no later than 14 days from the day we are informed of your decision. We may withhold the refund until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is earlier. You must send back the goods no later than 14 days from the day you communicate the withdrawal. You bear the direct cost of returning the goods unless we agree otherwise or the goods were defective/misdescribed.

Diminished value: You are liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Exclusions: The right of withdrawal does not apply to, for example: (i) sealed goods not suitable for return due to health protection or hygiene reasons once unsealed; (ii) customized or personalized goods; (iii) goods which are, after delivery, inseparably mixed with other items; and other cases under applicable national law.

10. Returns, exchanges and refunds (contractual policy)

Our contractual Return Policy (including instructions, addresses and any extended return periods) forms part of these Terms and is available on the Site. Statutory rights remain unaffected.

11. Legal guarantee of conformity; warranties

11.1 Legal guarantee (consumers)

If the goods lack conformity at delivery, you are entitled to free of charge remedies under applicable law (Directive (EU) 2019/771 as implemented in your country), including repair or replacement, or—where statutory conditions are met—price reduction or rescission. The legal guarantee lasts at least two years from delivery (or longer where required by national law). Please contact us with your order details and a description of the issue.

11.2 Commercial warranty (if offered)

Any additional commercial warranty we may offer (e.g., extended warranty) is described on the product page or in the documentation provided and is in addition to your statutory rights. Terms of any such warranty will prevail for its scope.

12. Promotions, vouchers and gift items

Promotional codes or vouchers are subject to stated conditions (validity period, exclusions, minimum order value) and are not redeemable for cash. If a promotion includes a gift with purchase, the gift must be returned if you withdraw from or partially return the qualifying order and the promotion conditions are no longer met.

13. Reviews and user content

If you submit reviews, questions, images or other content, you grant us a non exclusive, worldwide, royalty free license to use, reproduce, display, and distribute that content in connection with the Site and our marketing, subject to your privacy rights. You are responsible for your content and must not post unlawful, infringing, defamatory or misleading material.

14. Prohibited uses

You must not: (i) misuse the Site; (ii) interfere with security or access control features; (iii) use automated means to scrape data without our written consent; (iv) purchase for resale without prior agreement; or (v) engage in fraudulent activity.

15. Liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, and gross negligence under applicable law.

Subject to the preceding sentence, and to the extent permitted by law: (a) we are not responsible for indirect or consequential losses (e.g., loss of profits, business, or data); and (b) our aggregate liability for claims arising out of or in connection with each purchase is limited to the amount you paid for the goods concerned. Your statutory consumer rights remain unaffected.

For German consumers: the above limitations apply in accordance with §§ 309 No. 7–8 BGB and related jurisprudence; your mandatory rights under German consumer law remain unaffected.

16. Events outside our control (force majeure)

We are not liable for failure or delay caused by events beyond our reasonable control (e.g., strikes, lockouts, natural disasters, epidemics, wars, governmental actions, transport or telecommunication failures). We will take reasonable steps to minimize the effects and perform as soon as reasonably possible.

17. Personal data

Your personal data is processed in accordance with our Privacy Policy and Cookie Settings, available on the Site.

18. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations (in whole or part) to an affiliate or in connection with a reorganization, merger, acquisition or transfer of business, provided this does not prejudice your statutory rights.

19. Changes to the Terms

We may update these Terms to reflect changes in our services, legal requirements or business needs. The Terms in force at the time of your order will apply to that order. For material changes affecting ongoing user accounts, we will provide reasonable advance notice.

20. Governing law and dispute resolution

These Terms and any disputes arising out of or in connection with them are governed by the laws of Poland or, at our option, the laws of the Member State where our EU fulfilment center is located, without prejudice to the mandatory consumer protection of your country of residence (Article 6(2) Rome I).

You may bring proceedings in the courts of your domicile or in the courts of the Member State specified above. We are neither obliged nor generally willing to participate in dispute settlement proceedings before a consumer arbitration board, but we are required to inform you of the EU Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr
